By accessing or using Ezer Agent services at https://www.ezer-agent.com, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

2. Description of Services

Ezer Agent is an AI-powered call answering, lead management, and appointment booking platform designed for local service businesses. Services include:

• AI voice agents that answer inbound calls 24/7
• Missed call text-back automation
• Appointment booking and calendar management
• SMS and email follow-up sequences
• Lead tracking and CRM pipeline management
• Review generation (Growth plan and above)
• Facebook and Google ad management (Done For You plan)

3. Subscription Plans and Billing

Ezer Agent offers the following monthly subscription plans:

Subscriptions are billed monthly. By subscribing, you authorize us to charge your payment method on a recurring monthly basis until you cancel.

4. Cancellation Policy

5. Setup and Onboarding

Upon subscribing, our team will contact you within 24 hours to begin configuring your Ezer Agent account. Setup is handled entirely by our team — you are not required to perform any technical configuration yourself.

6. Acceptable Use

You agree to use Ezer Agent services only for lawful business purposes. You may not use our services to send spam, violate applicable laws (including TCPA and CAN-SPAM), misrepresent your business, or interfere with our platform.

7. SMS Compliance

By using Ezer Agent's SMS features, you agree to comply with all applicable SMS regulations including the Telephone Consumer Protection Act (TCPA) and A2P 10DLC requirements. You are responsible for ensuring your contacts have opted in to receive messages from your business.

8. Limitation of Liability

Ezer Agent and Tallmadge Automotive & Truck LLC are not liable for any indirect, incidental, or consequential damages arising from your use of our services. Our total liability for any claims shall not exceed the amount you paid us in the three months prior to the claim.

9. Service Availability

We strive to maintain consistent service availability but do not guarantee uninterrupted service. We are not liable for downtime caused by third-party providers including GoHighLevel, telecom carriers, or internet service providers.

10. Intellectual Property

All content, branding, scripts, and materials provided by Ezer Agent are the property of Tallmadge Automotive & Truck LLC. You may not reproduce or resell our materials without written permission.

11. Changes to Terms

We may update these Terms of Service at any time. Continued use of our services after changes are posted constitutes acceptance of the updated terms.

12. Governing Law

These Terms are governed by the laws of the State of Ohio. Any disputes shall be resolved in the courts of Summit County, Ohio.
